As soon as homeowners demand a security deposit for rented properties, various questions arise. When a rental agreement is concluded, the real estate deposit is a monetary payment made by the tenant to the landlord. This rental deposit is also known as a rental security deposit. The deposit for the rented property is usually due at the beginning of the rental agreement. Property owners benefit from this monetary payment as a safeguard in the event of rent defaults or tenants causing serious damage with consequential costs. The typical type of rental deposit is a cash deposit, which is provided either in cash or via bank transactions. In principle, the deposit amount must be held in separate rental deposit accounts until it is repaid.

Alternative to traditional rental deposits through rental guarantees

Tenants who do not want to pay a real estate deposit for rented properties with their own money can find a potential alternative in a rental guarantee. Under a guarantee, a guarantor takes care of the deposit payment on behalf of the tenant. Typically, family members act as guarantors for rental deposits in a private setting. This is particularly common among parents who support their children, for example, during their studies by acting as guarantors for a rental apartment.

Surety insurance as an exceptional variant of the surety bond

If a rental guarantee is to replace the real estate deposit, this idea can be implemented with guarantee insurance without help from private sources. Rental guarantee insurance is a guarantee and is therefore not the same as ordinary insurance. This is because tenants provide a rental security deposit and do not insure a deposit. While deposit insurance replaces a rental deposit, landlords receive a guarantee certificate. Tenants, in turn, receive an insurance policy. Rental deposit insurance can be taken out through reputable providers such as EuroKaution. This is particularly beneficial for tenants who are unable to provide the landlord with a property deposit immediately. In addition, surety insurance avoids a double burden, as a deposit is still required for the previous rental apartment. Tenants can use the guarantee to pay other moving costs more easily without an additional deposit burden. Deposit insurance often prevents those affected from having to rely on loans. For rental deposit insurance, tenants regularly transfer a contribution to banks, insurance companies, or other providers, which is usually based on the required deposit amount.

Advantages and disadvantages of rental deposits for tenants and landlords

When tenants pay a real estate deposit for rented apartments, the secure storage of the amount in rental deposit accounts until the end of the tenancy is a decisive advantage. Residents can get back the entire deposit amount after moving out, together with interest, as long as no pro-rata retention is due according to the rental agreement. Tenants also benefit from the fact that the real estate deposit can usually be paid in three monthly installments when they move in. An obvious disadvantage from the tenant's perspective, however, is that high deposit amounts are often associated with a financial burden and can significantly restrict the budget during a move. In the worst case, cash deposits make a deposit loan necessary. There is also the risk that repayment will be delayed after the lease is terminated, further prolonging the problematic waiting period. For landlords as owners, the real estate deposit offers the advantage of providing security in the event of potential payment defaults. In addition, the deposit can be accessed in the event of relevant damage. One disadvantage from the landlord's point of view is the strict restrictions imposed by the requirements for keeping the deposit amount in a rental deposit account. Rental deposits are generally never available for use by property owners during the entire rental period.

Costs associated with the real estate deposit for rental agreements

If a real estate deposit is due as a result of renting, a necessary rental deposit account may incur costs. This is because typical rental deposits in Germany must be held in interest-bearing accounts. Savings accounts, call money accounts, or checking accounts with interest on credit balances are among the options available for this purpose. While the real estate deposit for rented apartments is paid into such deposit accounts, a one-time fee is sometimes charged for opening the account. These opening fees range from €15 to €50 for many providers. However, some banks allow their existing customers in particular to open a rental deposit account free of charge, as long as the real estate deposit is transferred to it exclusively for rented properties. In theory, additional costs are conceivable due to possible account maintenance fees. Whether the account can be closed free of charge also depends on individual conditions. However, such costs rarely occur with traditional rental deposit accounts for rented private apartments with real estate deposits. If the homeowner has set up the account for the rental deposits themselves, they will cover the fees charged as the landlord. Instead, the tenant opens a separate bank account for the real estate deposit, and the parties involved are free to agree on the costs. Before the deposit is refunded, any outstanding operating costs and other justified claims by the landlord may be deducted from it.

Limiting the maximum amount of rental deposits in Germany

Homeowners cannot agree on any amount they want for a real estate deposit in Germany for rented apartments as long as the property is used privately. This is because there is a maximum amount that limits the deposit. The sum of a maximum of three months' net rent is the decisive limit for the real estate deposit. If the tenant transfers advance payments for heating and operating costs together with the monthly rent, this does not increase the maximum amount. The tripled net rent without heating remains the only basis for calculation. Legally, this limit is regulated in Germany by the Civil Code.
